RULE 14 - DEFAULTS AND DISMISSALS BY THE COURT In all cases where default judgment is available to a party by reason of failure of defendant to answer or enter an appearance, failure thereafter of such party to make demand for judgment by default under Ohio Civil Procedure Rule 55 (A) within sixty (60) days from the time that Plaintiff has notice of defendant=s default, may constitute cause for dismissal, with prejudice, of the complaint by the Court for want of prosecution. An entry shall be filed in each case in which such action is taken. At that time, the Clerk shall distribute or refund according to law, the balance of any security deposit or other funds on hand or bill for outstanding amounts due. |
